Terms of sale and service.
These Terms govern the use of the CHROMA & CHORA website, standard online purchases, customised and bespoke orders, Interior Furnishing services, procurement and related delivery services.
"CHROMA & CHORA", "we", "us" and "our" refer to CHROMA & CHORA. By accessing the website, placing an order, accepting a quotation or approving a project proposal, you agree to the applicable parts of these Terms.
01Eligibility and authority
You must provide accurate information and have legal capacity and authority to place the order or approve the project.
Where you act for a business, property owner or another person, you confirm that you have authority to bind that party.
02Website use
You must not use the website unlawfully, fraudulently or in a manner that interferes with security, performance or other users.
You must not scrape, reproduce, reverse engineer, commercially exploit or attempt to manufacture from our website content, imagery, drawings or product designs without written permission.
03Product information
We take reasonable care to present product descriptions, dimensions, materials, finishes, prices and photographs accurately. However:
- Screen displays and lighting affect colour
- Natural materials vary
- Hand-applied finishes vary
- Dimensions may include reasonable manufacturing tolerances
- Product details may be updated where the essential character is not materially altered
Nothing in this section permits a product to be materially different from its confirmed description or limits an applicable consumer guarantee.
04Standard Shopify orders
Standard collection products are purchased through Shopify checkout. Before payment, the customer must check:
- Product
- Variant
- Colour
- Finish
- Dimensions
- Quantity
- Delivery address
- Contact information
- Delivery option
- Property access
An automated order message acknowledges the transaction but remains subject to payment verification, product availability and acceptance.
We may cancel an order before dispatch where reasonably necessary because of unavailability, genuine pricing or description error, payment failure, suspected fraud or inability to arrange safe delivery. Any relevant payment will be refunded.
05Customised and bespoke furniture
Custom work begins with an enquiry and written specification. The specification may identify:
- Design
- Dimensions
- Materials
- Finishes
- Quantity
- Price
- Production estimate
- Delivery arrangements
- Exclusions
The customer must approve the specification in writing. Full payment is required before materials are ordered and production is scheduled. Production will not begin until payment has cleared and the specification has been approved.
Changes after approval remain subject to feasibility, revised pricing and updated timing. Changes may not be possible once materials are committed or production begins.
06Interior Furnishing services
Interior Furnishing services are governed by the accepted project proposal, these Terms and any later written variations. The proposal will define:
- Included rooms
- Design services
- Deliverables
- Design fee
- Payment schedule
- Revision scope
- Intended project stages
- Exclusions
- Procurement services, if any
The design fee is separate from procurement costs.
Unless expressly stated, the service does not include architectural surveying, building design, structural advice, electrical engineering, construction documents, statutory approval or certification.
07Plans, measurements and site information
The client must provide accurate plans, dimensions, photographs, access information and property requirements. CHROMA & CHORA may rely on the supplied information.
Advice, layouts and visualisations based on client-supplied measurements do not constitute a professional site survey. Where dimensions or building conditions are critical, the client must engage an appropriately qualified person to verify them.
08Visualisations and design representations
Rendered views, mood boards, drawings and digital visualisations communicate design intention. They are not guarantees of exact screen colour, natural-material pattern, lighting effect or final visual appearance.
Unless identified as technical documentation, they must not be used as architectural, engineering, electrical or construction drawings.
09Client review and approval
The client must review all relevant documents before approval, including dimensions, quantities, finishes, spelling, delivery information and product selections.
Written approval authorises CHROMA & CHORA to proceed on the basis of the approved information. Changes following approval may incur additional fees and delay.
10Design fees
Design fees relate to the professional services identified in the proposal. Payment is required according to the proposal before the relevant design stage begins.
Where the client pauses, cancels or changes the project after work begins, fees for services already performed remain payable, subject to applicable law. Unused design work does not automatically create a right to a refund.
11Procurement
Procurement begins only after the design and relevant products have been approved. A procurement quotation may include:
- CHROMA & CHORA furniture
- Custom furniture
- Third-party products
- Supplier charges
- Freight
- Delivery
- Assembly
- Installation
- Storage
- Other agreed costs
No product is ordered until the applicable quotation has been accepted and payment received. Supplier prices and availability may change before payment and order confirmation.
12Third-party products
Where CHROMA & CHORA procures a third-party product, availability, production and delivery may depend on the relevant supplier. We will take reasonable steps to communicate applicable product information and supplier changes.
The product remains subject to applicable consumer guarantees and any relevant supplier warranty.
13Prices, GST and payment
Unless stated otherwise, prices are in Australian dollars and include GST where applicable. Additional delivery, installation, access, storage and specialist-service charges apply where shown at checkout or quoted.
Payments are processed through Shopify or the payment method stated in the quotation or invoice. We do not ordinarily receive or store complete payment-card information.
14Promotions and pricing errors
Promotions apply according to their stated conditions and period. A promotion cannot be combined with another offer unless expressly stated.
We may correct genuine pricing or description errors. Where an error materially affects an order, we will contact the customer before proceeding or cancel the affected order and refund the payment.
15Delivery
The customer must provide an accurate address, contact details and access information. Delivery estimates are not guaranteed dates unless expressly confirmed in writing.
Additional charges may apply where delivery is unsuccessful because of inaccurate information, unsuitable access, absence of an authorised recipient or failure to arrange required building access.
16Assembly, installation and placement
Assembly, installation or placement is included only where expressly stated.
Unless agreed, services do not include electrical work, plumbing, structural work, wall fixing, building modification, cranes, external lifts, old-furniture removal, packaging removal or storage.
17Risk and inspection
Risk in a product passes to the customer upon delivery to the nominated address or authorised recipient, subject to applicable law.
The customer should inspect the order at delivery where reasonably possible and report visible transport damage or discrepancies promptly. This does not impose an unlawful time limit on consumer rights.
18Cancellations and returns
Standard and custom cancellation requests are handled under the Returns and Consumer Guarantees policy.
Custom products and procurement orders may not be cancellable for change of mind after approval, payment, supplier ordering or production commencement. Nothing in this section limits applicable consumer rights.
19Care and use
The customer must use products for their intended purpose and follow product-specific and general care information.
Damage caused by misuse, unsuitable cleaning, unauthorised modification or improper installation may not be covered by a warranty or consumer remedy, subject to applicable law.
20Intellectual property
All CHROMA & CHORA branding, writing, photography, graphics, product designs, drawings, visualisations, layouts and other creative material are owned by or licensed to us.
Payment for a product or design service does not transfer ownership of underlying intellectual property unless expressly agreed in writing.
The customer may use project documents for the personal or business project for which they were supplied, but may not manufacture, reproduce, sell or commercially distribute our designs without permission.
21Client-supplied material
The client confirms that they have the right to provide photographs, plans, drawings and references. References are used to understand direction and do not authorise copying protected third-party work.
We will not publicly identify or publish a private residential project without permission, except as required by law.
22Photography and portfolio use
We will seek permission before using identifiable photographs of a private client's completed interior for public marketing or portfolio purposes.
Any agreed photography arrangement may be recorded separately in writing.
23Privacy
Personal information is handled according to our Privacy Policy and applicable law.
24Third-party platforms
The website and services may use Shopify, payment providers, delivery companies, suppliers and other platforms.
Third parties operate under their own terms and privacy practices. Nothing in this section limits any responsibility that cannot lawfully be excluded.
25Events outside reasonable control
Production, procurement or delivery may be affected by supply interruption, transport disruption, natural events, industrial action, government action or similar events outside reasonable control.
We will take reasonable steps to communicate material effects and provide an appropriate response under the order and applicable law.
26Liability
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
To the extent permitted by law, we are not responsible for loss caused by inaccurate client information, unsuitable site conditions, misuse, unauthorised alteration, failure to follow care instructions or unrelated third-party work.
27Suspension or termination
We may suspend access, refuse service or cancel an unfulfilled order where reasonably necessary because of fraud, abuse, unlawful conduct, safety risk or material breach of these Terms.
Where an order is cancelled, any refund will be determined according to the circumstances and applicable law.
28Changes to these Terms
We may update these Terms to reflect operational, technical or legal changes. The current version and effective date will appear on this page.
Changes do not retrospectively alter an accepted order unless agreed or required by law.
29Severability and waiver
If part of these Terms is found invalid or unenforceable, the remaining provisions continue to operate where legally possible.
A failure to enforce a provision on one occasion does not waive the right to enforce it later.
30Governing law
These Terms are governed by the laws of New South Wales, Australia, subject to applicable consumer rights.
